Welcome to LUMI Yoga & Pilates, operated by Berrymoon GmbH (“we”, “us”, or “our”).
By accessing or using our website lumiberlin.de and booking classes through our integrated platform (Eversports), you agree to the following Terms & Conditions. Please read them carefully before using our services.

2. Scope

These Terms & Conditions apply to all users of our website and all participants who purchase, book, or attend classes, workshops, events, or memberships offered by LUMI Yoga & Pilates through Eversports or any other online channel.

3. Online Booking & Payments

  • All class passes, drop-ins, and memberships must be booked and paid online via our booking partner Eversports.

  • Payment is due immediately upon booking. Accepted payment methods are displayed during checkout.

  • Once payment is confirmed, you will receive an email confirmation of your booking.

  • Prices are shown in euros (EUR) and include applicable VAT.

4. Memberships, Drop-ins & Trial Offers

  • Drop-ins: Valid for a single class at the selected date and time.

  • Memberships: Provide access according to the plan purchased (e.g. monthly, annual). Specific conditions (e.g. class limits, cancellation notice) are displayed during purchase.

  • Trial or Intro Offers: May be purchased once per person unless otherwise stated.

  • Gift Cards: Are valid for 3 years from the date of purchase and may be redeemed for classes or memberships via our booking system. Gift cards are non-refundable.

5. Cancellations & No-Shows

  • Class cancellations must be made directly via Eversports within the cancellation window shown during booking (typically 12–24 hours before class start).

  • Late cancellations or no-shows will result in the class being charged in full.

  • Memberships cannot be paused or refunded except in cases of medical necessity (proof required).

6. Studio Rules & Conduct

  • Please arrive on time for your class. Late arrivals may not be admitted once class has started.

  • Mobile phones must be silenced inside the studio.

  • We reserve the right to deny participation to anyone whose behavior is unsafe or disruptive.

  • Personal belongings are your responsibility; we cannot accept liability for loss or theft.

7. Health & Liability

  • Participation in any LUMI Yoga & Pilates class is at your own risk.

  • By booking a class, you confirm that you are physically fit to participate and will inform the instructor of any injuries or health conditions.

  • LUMI Yoga & Pilates and its instructors are not liable for injuries, accidents, or damages that occur during or as a result of class participation, except in cases of gross negligence or intent.

8. Right of Withdrawal

As an online consumer, you have the right to withdraw from your purchase within 14 days without giving any reason.
To exercise this right, you must notify us in writing at hello@lumiberlin.de before the 14-day period expires.

If you begin using your class pass, membership, or service before the end of the withdrawal period (e.g., by attending a class), you acknowledge that your right of withdrawal expires once the service has been fully provided.

Refunds will be issued using the same payment method you used for the original transaction.

9. Intellectual Property

All content on lumiberlin.de, including text, graphics, images, and videos, is owned by or licensed to Berrymoon GmbH. You may not copy, reproduce, or distribute any materials without our written consent.

10. Privacy Policy

We take your privacy seriously.

We collect and process personal data (e.g. name, email, booking history) solely for the purpose of managing your classes, processing bookings, and communicating with you.

Data processing follows the General Data Protection Regulation (GDPR) and applicable German data protection law.

Our booking platform Eversports GmbH (Austria) acts as a data processor on our behalf for class scheduling and payment processing.

We also use Squarespace Inc. (USA) as our website hosting provider and Zapier Inc. (USA) to automate certain administrative workflows — for example, to securely transfer your contact information (name and email address) from our website to our email system Brevo (Sendinblue SAS, France), which we use for newsletters and community updates.

Transfers to the United States are protected through the EU–US Data Privacy Framework and Standard Contractual Clauses (SCCs) approved by the European Commission to ensure an adequate level of data protection under Art. 46 GDPR.

We process your data based on your consent (Art. 6 (1)(a) GDPR). You can withdraw this consent at any time by emailing hello@lumiberlin.de or by unsubscribing from our mailing list.

You may request access, correction, or deletion of your data at any time by contacting us.
We do not share or sell your personal data to third parties for marketing purposes.

11. Cookies & Tracking

Our website uses cookies and similar technologies to improve user experience and analyze traffic.

  • Essential cookies help the website function properly (e.g. booking system).

  • Analytics cookies (e.g. Google Analytics) help us understand how visitors use our site.

  • You can control or disable cookies in your browser settings.

12. Newsletter & Communications

If you sign up for our newsletter or mailing list, we will use your contact information to send you updates, offers, and event news.

When you submit a form on our website (e.g. contact request, waitlist registration), your data (name and email address) is transmitted via Squarespace and Zapier to Brevo, our EU-based email and marketing automation platform.

These tools help us manage our communication efficiently and securely. Transfers involving US-based providers (Squarespace, Zapier) are protected by the EU–US Data Privacy Framework and Standard Contractual Clauses (SCCs).

Only non-sensitive data is processed, and all transmissions occur via encrypted connections. You can unsubscribe at any time by clicking the “unsubscribe” link in any email or by contacting us at hello@lumiberlin.de to access, correct, or delete your data.

13. Website Use

You agree to use our website only for lawful purposes and in a way that does not infringe the rights or restrict the use of others.
We are not responsible for any technical errors, outages, or inaccuracies on third-party platforms (including Eversports).

14. Changes to Services & Terms

We may update class schedules, pricing, or these Terms & Conditions at any time. Updates will be posted on this page and apply immediately upon publication.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany.
The exclusive place of jurisdiction is Berlin, unless otherwise required by mandatory consumer protection laws.
